Traffic Management Act 2004
Councils will have to be more transparent about their parking management policies, undertake regular reviews of policies through consultation with stakeholders and communicate these policies effectively to the public. They are also encouraged to provide training for everyone involved in parking management and enforcement.
Additional powers are being given to independent adjudicators. They will be able to refer cases back to the chief executives of Local Authorities’ where a parking contravention has taken place in mitigating circumstances and can ask the Local Authority to consider cancelling the penalty charge.
Enforcement will also be "proportional" to the contravention's seriousness, with new regulations providing for differential charges. Higher penalties will apply for such matters as parking on a double yellow line and a lesser charge for overstaying on a meter.

Parking Enforcement
The Civil Enforcement Officer will enforce all parking on yellow lines, on lines outside schools, loading bays, overstaying time periods in limited time areas and not parking within the marked bays in the borough.
Parking on footways and verges in those locations where there is a yellow line restriction in place is also illegal and Civil Enforcement Officers will enforce the footway/verge in exactly the same ways as the roads.
Disbled badge holders are reminded to park in accordance with the guidance issued with their badges. They should ensure that the badge and clock are displayed correctly whenever the vehicle is parked.
Why the Change
Increased traffic congestion, dangerous and illegal parking are causing problems for all road users. Residents and visitors have expressed concern about parking problems and the change in enforcement will enable the Council to:
- Improve road and pedestrian safety
- Reduce pollution and traffic congestion
- Improve access for public transport and cyclists
- Improve the street environment for those who visit or work in the Borough
- Provide improved access to shops and business
